1. Acceptance
By creating an account or using Jungler.ai's website, app, API, or related services ("Service") provided by Viacurrent OÜ (Estonia reg. 16798201, Nafta 6-25, Tallinn), you agree to these Terms. If you use the Service for a company, you confirm you can bind that company. If you do not agree, do not use the Service.
2. Eligibility & Accounts
You must be at least 18 years old and able to form legally binding contracts. Keep credentials confidential; you are fully responsible for everything done through your account.
3. License & Intellectual Property
We own or license all software, content, and trademarks on the Service. We grant you a non-exclusive, revocable, personal licence to use the Service solely for its intended purpose. You may not copy, reverse-engineer, or resell any part of the Service without written permission.
4. Free Trial, Fees & Payment
- New users get one free trial per account (duration shown on the pricing page).
- After the trial, continued use requires a paid plan processed via Stripe. Subscriptions renew automatically at the end of each billing period until cancelled.
- Prices may change with at least 30 days' written notice.
- First-charge money-back guarantee: If you decide a paid plan isn't for you, email team@jungler.ai within 30 days of your first ever paid charge and we'll refund it in full, provided you've used less than two thirds of one billing month's credit allowance since that charge (on annual plans, your annual allowance divided by twelve). This applies once per customer, on monthly and annual plans alike.
- After that: Because paid plans include upfront usage credits, subsequent payments are generally non-refundable. If you believe there was a billing error or you forgot to cancel a trial, email team@jungler.ai within 7 days of the charge and we'll review on a case-by-case basis.
5. Cancellation
Cancel any time in your dashboard; access continues until the end of the current paid period. No further charges after cancellation.
6. Your Content and Data
You keep ownership of anything you upload, connect, create, or export through the Service ("Customer Content"). You give us the limited rights we need to host, process, enrich, analyse, display, and transmit it only to operate, secure, support, and improve the Service.
For personal data you submit or generate in the Service, our Data Processing Agreement applies where we act as your processor.
7. Your responsibilities
You are responsible for how you use data from the Service, including searches, exports, outreach, and data sent to tools you connect. You must have the rights and lawful basis needed for your Customer Content and your campaigns, and you must follow the privacy, anti-spam, platform, and marketing rules that apply to you.
When you connect a third-party tool such as Clay, Google Sheets, HeyReach, Smartlead, Slack, or a webhook, you choose what to send and remain responsible for that data after it leaves Jungler.
8. Prohibited Use
Do not:
- Break any law, violate anyone's rights, or send unlawful outreach.
- Attempt to interfere with security or functionality.
- Upload special-category data, criminal-conviction data, consumer data, or data you have no right to use.
- Resell, scrape, bulk export, or use the Service to build a competing product except as allowed by your plan or a written agreement with us.
- Send spam, distribute malware, or try to bypass usage limits.
9. Privacy and DPA
Your personal data is handled under our Privacy Policy. Business customers that process Customer Data with Jungler are also covered by our Data Processing Agreement and sub-processor list.
10. Availability
We work hard to keep the Service running, but we don't offer a guaranteed uptime SLA on standard plans. The Service may change, pause, or be interrupted from time to time, and we may deploy updates without prior notice. We take operational backups described in our DPA Annex 2; you remain responsible for keeping your own copies of anything critical you export from the Service.
11. Disclaimer
The Service is provided "as is" and "as available." We disclaim all warranties (express or implied). Use is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the last 12 months. We are not liable for indirect, incidental, or consequential damages.
Nothing in this section limits liability that can't be limited under applicable law — including liability for fraud, wilful misconduct, or liability owed to a data subject under Article 82 GDPR.
13. Indemnity
You will defend and indemnify Viacurrent OÜ against any third-party claim arising from your unlawful use of the Service or your Customer Content.
If a third party claims that your authorised use of the Service itself infringes their intellectual-property rights, we'll defend you against that claim and pay any final award or agreed settlement, provided you notify us promptly, let us control the defence, and reasonably cooperate. If we need to, we may modify the affected feature or, as a last resort, terminate it and refund unused pre-paid fees pro-rata. This doesn't apply to claims caused by your Customer Content, your use of the Service in breach of these Terms, or third-party services you choose to connect.
14. Termination
We may suspend or terminate your access at any time for breach of these Terms, misuse, non-payment, or to comply with law. Sections 3, 6–9, and 11–15 survive termination.
15. Governing Law & Disputes
Before starting court proceedings, both sides will try to resolve any dispute in good faith by writing to legal@jungler.ai and giving the other side 30 days to respond. If that doesn't work, either side may propose mediation; if the other agrees, mediation runs under the rules of the Estonian Chamber of Commerce and Industry. Nothing here stops you from contacting your data-protection authority or using mandatory consumer-protection remedies available where you live.
These Terms are governed by Estonian law. Any dispute not resolved as above will be settled in the courts of Harjumaa, Estonia, unless local consumer law in your EU country of residence requires otherwise.
